This is an application made pursuant to sections 74 and 96 of the Labour Relations Act, 1995 (the “Act”).
The responding party has requested that the Board dismiss allegations which do not disclose a prima facie case and which are not relevant to the complaint. It has not identified which parts of the voluminous material filed by applicant it asserts are not relevant.
While the Board may be persuaded to dismiss an application for a failure to make out a prima facie case, or dismiss certain allegations that may not be relevant, the responding party has not indicated which parts of the application it finds objectionable. Without that clarification, the Board is not prepared to undertake a review of all the applicant’s materials.
