DECISION OF THE BOARD; October 5, 2000
1This is an application for review of an Officer’s decision under section 68 of the Employment Standards Act (the “Act”). The application was scheduled for hearing before a Vice-Chair on October 5, 2000. The parties were advised of the hearing by way of correspondence from the Registrar of the Ontario Labour Relations Board.
2No one appeared at the hearing scheduled for October 5, 2000 on behalf of the applicant. The claimant and counsel for the Ministry of Labour attended and requested that the matter be dismissed. The Board waited its usual 30 minutes to accommodate any late arrivals, then dismissed the application in view of the failure of the applicant to attend.
DISPOSITION
3This application is dismissed. The Board directs that the monies held in trust be paid out to the claimant.
