DECISION OF THE BOARD; June 2, 2000
- This is a referral of a grievance to the Board for determination under section 133 of the Labour Relations Act, 1995, S.O. 1995, c. 1 (the "Act"). On the day scheduled for the hearing of this matter, the parties advised the Board that they had resolved the grievance by entering into minutes of settlement that have been filed with the Board. The parties’ minutes of settlement provide:

Responding Party
The Applicant filed a grievance on August 9, 1999 against the Responding Party;
The Applicant referred that grievance to the Ontario Labour Relations Board (the “Board”) on August 26, 1999 (Board File No. 1564-99-G);
The Parties want to settle the grievance on the terms set out herein;
NOW THEREFORE the Parties agree as follows:
The parties shall file these Minutes with the Board and request that the Board issue a decision incorporating these Minutes.
The Responding Party agrees that the Applicant has bargaining rights for its glaziers and glazing apprentices including its employees who install automatic, sliding glass doors in the ICI sector of the construction industry and in the non-ICI sectors of the construction industry in Board Area 8.
The Responding Party agrees that it has violated the Provincial Collective agreement between the Architectural Glass & Metal Contractors Association and the I.B.P.A.T., et al, effective until April 1, 2001.
The Applicant agrees not to claim damages against the Responding Party up to and including the date of this settlement.
IN WITNESS OF WHICH the Parties enter into this Agreement on the 2nd day of June, 2000.
