DECISION OF THE BOARD; June 8, 2000
1The applicants have referred grievances concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
2Prior to the hearing in these matters, the parties entered into a memorandum of agreement dated May 30, 2000.
3Having regard to the memorandum of agreement, to the material before it and pursuant to section 133 of the Labour Relations Act, 1995 the Board makes the following declarations and directions:
The Board declares that 1329802 Ontario Ltd. operating as Division Four is bound to the collective agreement effective May 1, 1998 to April 30, 2001 as between Brick and Allied Craft Union of Canada/BACU – Canada and The Masonry Industry Employers Council of Ontario.
The Board declares that 1329802 Ontario Ltd. operating as Division Four has violated the collective agreement mentioned above by failing to remit dues, benefits, contributions and deductions contrary to Articles 19 and 29.
The Board orders 1329802 Ontario Ltd. operating as Division Four to pay to the applicants forthwith, as damages, the amount of thirteen thousand nine hundred and sixty-eight dollars and sixty-three cents ($13,968.63) as full and final settlement for the above violations of the collective agreement in OLRB File 0388-00-G and three thousand seven hundred and twenty-nine dollars and sixty-eight cents ($3,729.68) in OLRB File
