DECISION OF THE BOARD; November 29, 2000
- Having regard to the agreement of the parties dated November 24, 2000 in these matters, and pursuant to subsection 69(8) of the Labour Relations Act, 1995 (the “Act”), the Board directs that representation votes be taken of the individuals in each of the following voting constituencies:
a) Service Unit
all employees of the Kenora District Board, in the City of Dryden save and except Supervisors, persons above the rank of supervisor, registered and graduate nurses, office staff.
b) Nursing Unit
all registered and graduate nurses employed by the Kenora District Board engaged in a nursing capacity, in the City of Dryden, save and except assistant director of nursing and director of inservice training and persons above the rank.
The votes will be held on Thursday, January 11, 2001. Other vote arrangements will be as determined by the Registrar and set out in the attached “Notice of Vote”.
The individuals entitled to cast a ballot in the representation vote taken in respect of the Service Unit are listed in Schedule “B” attached. In this representation vote, voters will be asked (in this sequence) if they wish to be represented by the Canadian Union of Public Employees (CUPE) or the Communications, Energy and Paperworkers of Canada (CEP) or the Office and Professional Employees International Union, Local 521 in their employment relations with Dryden Long Term Care Facility.
The individuals entitled to cast a ballot in the representation vote taken in respect of the Nursing Unit are listed in Schedule “C” attached. In this representation vote, voters will be asked (in this sequence) whether they wish to be represented by the Communications, Energy and Paperworkers of Canada (CEP) or the Ontario Nurses’ Association in their employment relations with the Dryden Long Term Care Facility.
The “winner” of the vote in each unit shall be the union with the most ballots cast in its favour. In the event that there is a tie for winner, there will be a run-off vote of the tied unions in that unit within two (2) weeks of January 11, 2001.
The responding parties to the applications in Board File Nos. 3979-99-R, 1345-00-R and 1436-00-R are directed to post copies of this decision and of the “Notice of Vote” where they are most likely to come to the attention of all employees who may be affected by these applications. These notices must remain posted for 14 days following the taking of the representation vote.
These matters are referred to the Registrar. These matters should be referred back to this panel of the Board, if convenient, for decision following the representation vote.
