Decision of the Board: October 17, 2000
1Having regard to the submissions of counsel for Giovanni Naccarato, the Board hereby lists for hearing the application for reconsideration in Board File No. 3080-94-G on October 31, 2000 and November 1, 2000. This matter is to be set down before the same panel hearing Board File No. 0667-00-R and 0668-00-G. That panel of the Board will determine its own process in dealing with these files.
2In setting down this application for hearing the Board is in no way ruling on the merits of any of the submissions of counsel for Mr. Naccarato. That is, counsel should not assume that the Board has accepted the proposition that his client has the right to bring this application. Further, the expert’s report, while admirably clear and to the point, will not likely be accepted as evidence without the calling of the expert who prepared the report.
3Counsel for the applicant trade union in all three files shall file a response to the application for reconsideration on or before October 27, 2000. That party is also entitled to an adjournment, if sought, for the purpose of preparing evidence for these matters.
