DECISION OF THE BOARD; December 14, 2000
Further to the Board’s decision of December 4, 2000, the Registrar has unsuccessfully canvassed the parties in order to set two hearing days prior to January 23, 2001.
In paragraph 71 of the Board’s decision of October 25, 2000, the Board indicated that it wanted to hear oral arguments from the parties on the subject of whether or not the Board would or should exercise its discretion to make a section 1(4) declaration even if all of the prerequisites of section 1(4) are satisfied in this application.
In light of the difficulty in setting any hearing dates before this matter had originally been set to convene, the parties are advised that the Board will hear arguments on the issue outlined above, and in the October 25th decision, beginning on January 23, 2001, and continuing on dates already set.
