DECISION OF THE BOARD; December 19, 2000
The Board is in receipt of a letter dated December 19, 2000 from counsel for the responding party in this application. Counsel advises that he is undergoing surgery on December 19, 2000 for which he has been on a waiting list. He has been advised that he will likely not be sufficiently recovered to attend the hearing scheduled for December 21, 2000. Accordingly, he requests an adjournment of that date.
The applicant opposes the request as its counsel advises it has a “fiduciary obligation to proceed” with this matter.
The Board hereby grants the responding party’s request as the personal circumstances described are sufficient reason to do so.
The matter is referred to the Registrar to be rescheduled at the earliest possible date.
