DECISION OF THE BOARD; September 20, 2000
This is a referral of a grievance to the Board for determination under section 133 of the Labour Relations Act, 1995, S. O. 1995, c. 1 (the "Act"). The Board attempted to send the Confirmation of Filing of Referral of Grievance to Arbitration and Notice of Hearing (Form B-67) to the responding party by facsimile transmission at the number provided by the applicant and despite several attempts, was unable to do so. The Board then sent the Form B-67 by courier to the responding party at the address provided by the applicant and the address where the applicant in the Certificate of Delivery it filed with the application says it had the application delivered to the responding party by courier. The Form B-67 was returned with a note indicating that the responding party is not at that address.
Before a responding party is required to file a Request for Hearing and Notice of Intent to Defend (Form A-87) the Board must send the responding party a Form B-67. The Board has been unable to do so as both the address and phone number for facsimile transmission the applicant has provided for the responding party are not accepting the documents the Board is attempting to send.
Under the circumstances, the Board directs the applicant to provide the Registrar with an address or facsimile number for the responding party that is capable of receiving material from the Board within 10 days of the date of this decision. This application will not be processed further until that information is received from the applicant. Should the applicant not provide the required information to the Registrar within that time, this application will be dismissed.
This matter is referred to the Registrar.
