DECISION OF THE BOARD; January 27, 2000
The Board is in receipt of an application under section 96 of the Labour Relations Act (the “Act”) filed by W.T. Lynch Foods Limited (the “company”) in respect of alleged misconduct by the United Food and Commercial Workers International Union, Local 175 (the “union”) in the conduct of its organizing campaign. The company seeks to rely on the facts raised in this unfair labour practice application in support of a request for relief under subsection 11(2) of the Act in relation to the certification application in Board File No. 3119-99-R. The company has asked that the Board transfer a copy of the material filed in support of its section 96 application to Board File No. 3119-99-R in support of its request under section 11(2) of the Act in the certification proceedings. The Board agrees to do so. The vote scheduled in the certification proceeding in Board File No. 3119-99-R will, however, proceed as previously directed by the Board in its decision dated January 26, 2000.
