This is a referral of a grievance in the construction industry, pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
It is related to Board File No. 0213-00-R, which is a request that 652067 Ontario Inc. o/a Elcana Masonry, Stan Vanderploeg Masonry Ltd. and Gerrit Vanderploeg & Co. Limited be found to be a single employer within the meaning of section 1(4) of the Labour Relations Act, 1995 and that the Board find there has been a sale of business.
In the Board’s view, it is appropriate to adjourn this matter until the issues in Board File No. 0213-00-R have been resolved.
This matter is adjourned sine die for a period not exceeding one year. Unless within that time either party requests that the Board proceed with this matter, it will be deemed terminated without any further notice to the parties.
