DECISION OF THE BOARD
1This is an employer appeal of a decision of an employment standards officer dated February 2, 1999.
2On the date and time scheduled for hearing in this matter no one appeared on behalf of either the employer or the employee. The representative from the Ministry of Labour did appear. The Board waited until approximately 10:30 a.m. and then convened the hearing.
3The notice of hearing dated September 14, 1999 states in paragraph 4:
IF YOU DO NOT ATTEND THE HEARING, THE BOARD MAY DECIDE THE APPLICATION WITHOUT FURTHER NOTICE TO YOU AND WITHOUT CONSIDERING ANY DOCUMENT FILED BY YOU.
4The address list attached to the notice lists both the applicant employee and the responding employer and no mail was returned to the Board.
5Having regard to the above this application is hereby dismissed.
