This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the “Act). The applicant alleges that the responding party has breached the statutory freeze in section 86 of the Act in changing the terms and conditions of employment of Monique Pomerleau.
The responding party submits that the applicant has failed to plead a prima facie case. The Board has reviewed the application, and is satisfied that the applicant has pleaded a prima facie case.
