On October 26, 2000, the Board issued a decision directing the applicant to make submissions by not later than October 30, 2000, on the issue of whether this application under section 63 of the Labour Relations Act, 1995 is timely.
As of November 2, 2000 the Board has not received submissions from the applicant on the timeliness issue. Given that the application itself names October 31, 2002 as the expiry date of the most recent applicable collective agreement, the application would appear to be untimely on its face.
