DECISION OF THE BOARD; July 5, 1991
This is an application for certification in which the union seeks to represent a group of service technicians employed by the respondent employer. The application indicates that the respondent's head office is in the Province of Quebec, and that the nature of the employees' work is such that they have no fixed workplace.
The Act and Rules contemplate that when an application for certification is made, notice of that application will be given to the employees potentially affected by it. Ordinarily, that notice can be given by a simple posting in the employees' workplace. Here, however, the employees do not have a fixed workplace, so that notice must be given to them by other means. Accordingly, the Board hereby directs that the respondent employer forthwith fax to the Board a list of its service technicians in the bargaining unit (i.e. working in the Province of Ontario) together with the addresses of those employees. Upon receipt of this information, the application will be processed in the ordinary course.
The respondent is further directed to advise the Board of its business address (if any) in Ontario.
