DECISION OF THE BOARD
The Board directs that the above application and complaint be and the same are hereby consolidated.
This is an application for certification in which the applicant union seeks to displace an incumbent. In addition the Board has before it a complaint under section 89 relating to the conduct of the employer in connection with this application for certification and an application under section 8 of the Act that the Board certify without a vote.
In a decision dated May 17, 1982, the Board found the applicant to be a trade union within the meaning of section l(l)(p) of the Act, and, as is the Board's practice in displacement applications, exercised its discretion under section 7(2) of the Act to set a voting constituency and direct the taking of a representation vote. Those eligible to vote were described as "all employees of the respondent in the voting constituency on the 14th day of May, 1982, who have not voluntarily terminated their employment or who have not been
