The applicant sought statutory accident benefits following a motor vehicle accident. The respondent denied benefits, arguing the applicant's injuries fell within the Minor Injury Guideline (MIG). The applicant claimed his psychological injuries and hearing loss warranted removal from the MIG. The Tribunal found the applicant failed to establish that his psychological condition or hearing loss removed him from the MIG, noting a lack of objective evidence and causation issues. However, the Tribunal ordered the respondent to pay for two assessments because it failed to provide timely notices of denial under s. 38(8) of the Schedule. The applicant's request for an award for unreasonable delay was dismissed.
