OVERVIEW
1Zaleena Bacchus, the applicant, was involved in an automobile accident on February 1, 2020, and sought benefits pursuant to the Statutory Accident Benefits Schedule — Effective September 1, 2010 (including amendments effective June 1, 2016) (the “Schedule”). The applicant was denied benefits by the respondent, Northbridge General Insurance Company, and applied to the Licence Appeal Tribunal — Automobile Accident Benefits Service (the “Tribunal”) for resolution of the dispute.
2The parties agreed the Minor Injury Guideline (MIG) is no longer an issue in dispute effective September 14, 2021.
ISSUES
3The issues in dispute are:
i. Is the applicant entitled to $1,991.12 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted February 9, 2021?
ii. Is the applicant entitled to $1,563.72 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted March 31, 2021?
iii. Is the applicant entitled to $1,926.47 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted May 12, 2021?
iv. Is the applicant entitled to $1,563.72 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted September 10, 2021?
v. Is the applicant entitled to $1,417.51 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted August 25, 2021?
vi. Is the applicant entitled to $1,417.51 for chiropractic services, proposed by Prime Health Care Inc. in a treatment plan submitted November 12, 2021?
vii. Is the applicant entitled to $2,460.00 for an orthopaedic assessment submitted by 101 Assessments in a treatment plan submitted August 9, 2021?
viii. Is the applicant entitled to $2,128.51 for an attendant care needs assessment submitted by 101 Assessments in a treatment plan submitted March 22, 2022?
ix. Is the respondent liable to pay an award under s. 10 of Reg. 664 because it unreasonably withheld
