OVERVIEW
1Ranjodh Singh Butter (the "appellant") appeals from the decision of the Registrar of Motor Vehicles (the "Registrar") to suspend their Class A driver's licence under s. 47(1) of the Highway Traffic Act, R.S.O. 1990, c. H.8 (the "Act").
2Following the hearing, I set aside the suspension and gave oral reasons for that decision with a written decision to follow.
3I also issued a confidentiality order with respect to certain documents presented at the hearing.
4The decision issued orally to the parties was of immediate effect.
Decision
5For the reasons given orally, and pursuant to s. 50(2) of the Act, the Tribunal orders as follows:
i. The Registrar's decision to suspend the appellant's Class A driver's licence is set aside.
ii. Pages 6, 9 and 10 of the Respondent's Submissions filed at the hearing as Exhibit 1 shall be treated as confidential and not disclosed to the public.
iii. A party seeking reconsideration of this decision must either have requested written reasons orally at the conclusion of the hearing or must do so in writing no more than 14 days after the date of this order.
iv. If a party wishes to make a request for written reasons, it shall make this request to the Tribunal no more than 14 days after the date of the hearing. The request for written reasons must be made in writing and be directed to the Tribunal's Registrar at LATregistrar@ontario.ca. If written reasons are so requested, the Tribunal will provide written reasons in due course. The date the Tribunal's written reasons are issued shall be the date of the decision for the purposes of a request for reconsideration under Rule 18 of the Licence Tribunal Rules, 2013.
