OVERVIEW
1Thusheyanthan Rajakulasooriyar (the “appellant”) appeals the impoundment of his motor vehicle under section 50.2 of the Highway Traffic Act, R.S.O. 1990, C. H.8 (the “Act”). The appellant’s motor vehicle was impounded on Monday, October 14, 2025. A Notice of Impoundment was issued for a period of 45 days.
2The appellant appeals on the grounds that the vehicle was taken without his permission by an acquaintance. The appellant filed a police report stating that the vehicle had been taken without his permission.
3On the evening of November 14, 2025, the Registrar contacted the Tribunal and advised that the vehicle was released to the appellant effective November 14, 2025.
4The appellant did not file a Notice of Withdrawal with the Tribunal and, therefore, the hearing commenced at 9:30 a.m. on November 17, 2025. The Registrar attended. After 10 minutes, the Case Management Officer reached out to the appellant to request that he call in to the hearing to confirm that the car had been returned and he was withdrawing his appeal.
5The appellant did not call into the hearing until 10:00 a.m., at which point the Registrar had left the hearing. The appellant advised the Tribunal that he was withdrawing his appeal and confirmed that the impounded vehicle had been returned.
RESULT
6For the reasons set out below the Notice of Appeal is dismissed.
ORDER
7The Tribunal Orders that the file be closed.
