BACKGROUND

1LP Hamilton Holdings Inc. o/a Valley Town Residence (“appellant”) appealed from an Order of the Deputy Registrar, Retirement Homes Regulatory Authority (“Registrar”) to pay Administrative Penalty No. 2024—SO515-93-01 issued May 3, 2024 (“Order”) made under s. 93 of the Retirement Homes Act, 2010, S.O. 2010, Chapter 11 (“Act”).

2Following a case conference held before me on June 3, 2024, both parties advised the Tribunal that they have resolved this appeal and that both parties request an order confirming that the appeal has been resolved on terms agreeable to both parties.

3The terms of the settlement reached are not attached to this Consent Order at the request of the parties.

4Both parties have confirmed that pursuant to section 4.1 of the Statutory Powers Procedure Act, R.S.O. 1990, c. S 2 (the “SPPA”), they waive the requirements of a hearing.

ON CONSENT OF BOTH PARTIES, I ORDER:

5Pursuant to s. 4.1 of the SPPA and on the consent of the parties, I dispose of this appeal without a hearing on the terms and conditions agreed to between the parties in a Consent signed by both parties June 20, 2024. The Registrar will issue an amended Order on the terms agreed to by the parties and the appellant will comply with the amended Order forthwith.
