ORDER
1Mr Pavlo Schovgeniouk, (“appellant”) appeals to the Licence Appeal Tribunal (“the Tribunal”) regarding a decision by the Registrar to impound his vehicle pursuant s. 55.1 of the Act. The appellant is the owner of a 2009 Honda Civic which was impounded on November 20, 2023. The appellant filed an appeal to lift the impoundment pursuant to sections 55.1 and 50.2 of the Act and its regulations. The appeal was filed on December 14, 2023. The appellant requested an extension of the timelines to file an appeal.
2A motion hearing was scheduled for the Tribunal to consider granting the extension of time or not. The Tribunal heard submissions from the parties at the motion hearing. The Tribunal heard the appellant in French and the respondent in English. An interpreter was present to translate between the parties.
3However, during the hearing, the appellant withdrew the application. The Tribunal ensured that the appellant understood the effect of withdrawing the application and the appellant confirmed his understanding.
RESULT
4The appellant withdrew his appeal, and the Tribunal has closed this matter.
