OVERVIEW
1The appellant, Thayaliny Arul, appeals the 45-day impoundment of her 2009 Acura RDX motor vehicle under section 55.1 of the Highway Traffic Act, R.S.O. 1990, c. H.8 (the "Act"). The Notice of Appeal was received by the Licence Appeal Tribunal (the "Tribunal") on June 14, 2023, which is outside of the legislated timeline to file the appeal.
2The appellant subsequently filed a Notice of Motion asking the Tribunal to grant an extension of time to file the appeal outside of the legislated timeline. A motion hearing was to proceed today.
3At the motion hearing, the appellant confirmed that she would like to withdraw her appeal. The appellant was asked to complete the Notice of Withdrawal form, available on Tribunals Ontario's website, and provide a copy to the Registrar.
RESULT
4As the appellant has withdrawn the appeal, the Tribunal's file is now closed.
