1The parties attended a hearing today, October 24, 2022, to address an application for an outdoor boulevard patio at the appellant’s premises located at 583 Parliament Street and 8 Amelia Street, Toronto (“Patio”).
2At the outset of the hearing the parties resolved the issues between themselves.
Order
3On the consent of the parties, the Tribunal directs the Registrar under the Alcohol and Gaming Commission of Ontario Act, 2019 S.O. 2019 c. C. 15, Sched 22 (“Registrar”) to issue a consume on premises licence to the appellant for the Patio subject to the following conditions:
a. That the the Registrar shall issue a liquor licence to the Applicant for the outdoor Premises with a capacity of sixty [60] persons.
b. The establishment will operate as a restaurant and not as a nightclub.
c. The Patio will be closed by 11:00 p.m. in accordance with Toronto Municipal Code Chapter 742: Sidewalk, Cafés, Parklets and Marketing Displays.
4The parties resolved the matter on consent at the outset of the hearing. The Tribunal will close its file.
