BACKGROUND
1This is an appeal of 2021-TO422-93-01 to Pay an Administrative Penalty (the “Order”) in the amount of $2,500.00.
2The Order was issued pursuant to s. 93 of the Retirement Homes Act, 2010 (the “Act”), because the Registrar had reasonable grounds to believe that the appellant contravened s. 75(1) of the Act by failing to report suspected neglect to the Registrar and s. 67(2) of the Act by failing to prevent the neglect of a resident.
3The parties have advised the Tribunal that they were able to agree upon a settlement related to the Order. As such, they have requested that the terms of settlement be incorporated into a Consent Order disposing of this proceeding.
ORDER
4Accordingly, on the consent of the parties, the following order is issued by the Tribunal:
i. The Order of the Retirement Homes Regulatory Authority (“RHRA”) dated February 19, 2021 is rescinded, in part, with respect to the finding that HCN-Revera Lessee (King Gardens) LP o/a King Gardens contravened section 75(1) of the Retirement Homes Act, 2010 by failing to report suspected neglect to the Registrar.
5The Tribunal shall vacate the following videoconference hearing date: June 29, 2021.
6This Tribunal file shall be closed.
