1Rule 3.4(d) of the Rules provides that the Tribunal may dismiss an appeal if the appellant is found to have abandoned the proceeding. The appellant was found to have abandoned the appeal. In a Notice of Intent to Dismiss an Appeal released February 12, 2019 the appellant was provided an opportunity to make written submissions to the Tribunal by February 22, 2019, as to why the appeal should not be dismissed, including an explanation why the appellant did not attend the hearing or whether the appellant wished to continue with her appeal or withdraw it.
2Nether the appellant nor the respondent made submissions in response to the Notice of Intent to Dismiss, and specifically as to why the appeal should not be dismissed as abandoned.
3The appellant did not attend the hearing, has not provided submissions in response to the Notice of Intent to Dismiss, and has not responded to the Tribunal’s requests made subsequent to the hearing of whether she intends to proceed with the appeal. I find that the appeal is abandoned.
ORDER
4It is ordered that the appeal is dismissed as abandoned.
