ORDER
1The applicant filed a request for reconsideration on this matter on October 21, 2019 in respect of a preliminary decision released on October 2, 2019.
2This request for reconsideration arises from an adjudicator’s motion decision that found the applicant was statute barred from proceeding to a hearing with respect to non-earner benefits as this specific claim had not been pursued within two years of its denial. The parties disputed this issue in the preliminary motion heard by the adjudicator. The application claims many benefits, however, this was the only one at issue before the adjudicator on this preliminary motion.
3On February 7, 2019, the Licence Appeal Tribunal, Animal Care Review Board, and Fire Safety Commission Common Rules of Practice and Procedure, Version I (October 2, 2017) were amended. Pursuant to the amended Rule 18.1, requests for reconsideration will only be accepted on Tribunal decisions that finally dispose of a matter. Pursuant to Rule 18.5, this change applies if the request for reconsideration relates to an order issued on or after February 7, 2019.
4As there are other issues in dispute that will be addressed at an upcoming hearing, the motion decision which is the subject of this reconsideration request does not finally dispose of the application.
5On this basis, the request for reconsideration is dismissed.
