Overview:

1The appellant applied to the Registrar, Motor Vehicle Dealers Act, 2002 for registration under the Act as a salesperson and a motor vehicle dealer. The Registrar issued a Notice of Proposal to Refuse Registration, dated June 21, 2018 (the “Proposal”).

2The appellant appealed to the Licence Appeal Tribunal under Section 9(2) of the Act, but the appeal documents were not received by the Tribunal and the respondent within the 15 day appeal period specified in the Act.

3Subsequently, on August 2, 2018, the appellant brought a motion to extend the time for the filing of the appeal.

4Counsel to the appellant described the circumstances which led to the appeal not being filed within the prescribed time limits, following which the respondent consented to the requested extension of time.

5The parties also agreed that it was in the interest of all to keep this matter progressing and agreed to schedule the case conference.

The Tribunal orders that:

6The time for the filing of the appeal of the Proposal be extended to September 15, 2018.

7A case conference be held by teleconference on October 2, 2018 at 9:30 a.m., for which a Notice of Case Conference will be circulated to the parties.
