On May 16, 2017, the respondent filed a Motion requesting direction from the Tribunal on the release of the Decision on a preliminary issue hearing and whether the release will impact the hearing scheduled for July 4, 2017.
The preliminary issue hearing is a written hearing with submissions required to be completed by June 12, 2017. It is unlikely the decision on the preliminary issue will be released in time for the parties to adequately prepare for the hearing.
The hearing scheduled to commence July 4, 2017 is cancelled. The parties will be contacted by the Tribunal to determine suitable dates for the re-scheduling of the hearing in August or September, 2017.
