Case Name: M.C. vs. Aviva General Insurance

On November 23, 2017, the respondent, Aviva General Insurance Company (“Aviva”), submitted a request for reconsideration that takes issue with an order of the Licence Appeal Tribunal (the “Tribunal”) issued on November 21, 2017. In that order, the Tribunal allowed the applicant, M.C., to summons the claims adjuster at Aviva who handled the claim in dispute. In the Tribunal’s view, M.C. was entitled to the summons given his request for a special award, which puts into question the manner in which his file has been handled. This matter is scheduled for hearing on November 27, 2017.
In its request for reconsideration, Aviva argues that it should have received a copy of M.C.’s motion materials requesting the summons, and should have been given the opportunity to make submissions in response. I disagree. Read together, Rules 8 and 4.3 of the Tribunal’s Common Rules of Practice & Procedure make clear that M.C. was entitled to make his request for the summons on an ex parte basis.
Aviva’s request also raises other concerns. However, these are beyond the scope of M.C.’s request for, and the Tribunal’s issuance of, the summons. Accordingly, I refuse to deal with them.
This request for reconsideration is therefore dismissed.
