ORDER
The Appellant brought a motion to extend the time for filing his appeal. The Notice of Proposed Order was served on the Appellant in and around August 22, 2014. The Appellant failed to appeal to the Tribunal within the 15 day appeal period. On October 23rd, the Appellant having failed to appeal to the Tribunal, the Registrar issued a Final Order. On or about November 13, 2014, the Appellant filed an appeal with the Tribunal. This date is approximately 10 weeks after the expiration of the appeal period.
The motion hearing was set to commence at 9:30 a.m. on January 7, 2015 at the Tribunal’s Chambers. The Appellant failed to appear. The Appellant has put no evidence before the Tribunal regarding the late filing of his appeal or any prejudice he might suffer as a result of not being granted an extension of time. The onus being on the Appellant to establish that he should be granted an extension of time, in the light of his failure to appear and advance any evidence, the Tribunal dismisses his motion for an extension of time. The Tribunal will now close its file.
