DECISION and ORDER
The Registrar of Alcohol and Gaming (the ‘Registrar”) under the Liquor Licence Act, (the “Act”) issued a Notice of Proposal, number 20440, dated July 9, 2014, to review the application for licence by Carman’s Dining Club Inc., the Appellant, on the basis that the Registrar has received one or more written objections to the application.
At the commencement of the hearing on September 23, 2014, Ms Taylor confirmed that the City of Toronto, one of the two objectors to the application, has withdrawn its objection. The other objector, identified as M.S. at the pre-hearing in this matter, did not attend the pre-hearing, nor did he attend this hearing though given notice by the Tribunal of each of these proceedings. The Tribunal did provide a fifteen minute grace period to allow for late attendance at the hearing. Ms Taylor advised that her colleague, Ms Harari, did attempt to contact M.S. after his nonattendance at the pre-hearing, to determine whether he intended to come to the hearing to state his objection. She received no response from him.
Ms Taylor also advised that the Registrar is not taking a position with respect to this application.
Therefore, there being no public interest objections to this application before the Tribunal at this hearing, and having heard submissions from the parties, the Tribunal makes the following order:
- The Tribunal hereby approves the application made by Carman’s Dining Club Inc. for a liquor sales licence at Carman’s Dining Club formerly known as Carman’s Club, 26 Alexander Street, Toronto, subject to the filing of all usual and required municipal clearance letters and application requirements.
