ORDER
The Registrar of Alcohol and Gaming (the “Registrar”) under the Liquor Licence Act (the “Act”), issued the Notice of Proposal, number 19680 dated February 20, 2013, to review an application to licence an additional outdoor area by 1825053 Ontario Inc. o/a Caché on the basis that the Registrar has received one or more written objections to the application.
On April 26, 2013, the Tribunal held a pre-hearing for this matter. The individual Objector did not appear and a hearing date was set for May 10, 2013, commencing at 9:30 a.m. The parties and the individual Objector were duly notified of the date, time and location for the hearing. The hearing convened as scheduled on May 10, 2013.
At 10:10 a.m., the Tribunal noted the presence of the Applicant, the Applicant’s representative and that of the Registrar’s representative. The individual Objector had not appeared at that time and no communication of any kind had been received to indicate anyone else intended to attend on his behalf.
Ms. Varva then advised the Tribunal that the Registrar took no position on the matter. There being no objector(s) present, the Tribunal received the exhibits and concluded the hearing.
The Tribunal therefore orders as follows:
- Pursuant to the authority vested in it under the provisions of the Act, and for the reasons stated above, the Tribunal approves the application by 1825053 Ontario Inc. o/a Caché, and directs the Registrar to issue the licence for the additional outdoor area at Caché, 42-44 James Street, St. Catharines, licence number 0806938 subject to compliance with all statutory conditions and municipal regulations.
