Genesis Garden Inc. o/a La Résidence Le Genesis (the “Appellant”) has appealed an Order to pay an Administrative Penalty issued by the Registrar of Retirement Homes Regulatory Authority (the “Registrar”) on September 23, 2015.
The Appellant made a motion on October 29, 2015, seeking an order granting a stay of the Registrar’s Order. The Appellant’s Motion materials included a copy of the Registrar’s consent to a stay of the Registrar’s Order to Pay Administrative Penalty pending the Tribunal’s hearing and decision on the appeal of this matter.
The Tribunal ordered as follows:
On consent of the parties, the Tribunal grants a stay of the Registrar’s Order to Pay Administrative Penalty dated September 23, 2015, pending the Tribunal’s final decision in this appeal or until the Tribunal orders otherwise.
The pre-hearing in this matter will proceed as previously scheduled on November 13, 2015, starting at 9:30 a.m. via teleconference.
In the event of a withdrawal of the Order, withdrawal of the appeal or settlement/resolution of the issues in advance of the pre-hearing date, both parties shall advise the Tribunal in writing of the resolution and request that the pre-hearing, no longer required, be cancelled. If the Applicant is withdrawing the appeal, the Applicant shall file with the Tribunal a Notice of Withdrawal available at www.lat.gov.on.ca.
