The Registrar of Alcohol and Gaming (“the Registrar”) under the Liquor Licence Act issued a Notice of Proposal dated March 9, 2012 to refuse to transfer liquor licence no. 809515. The Applicant appealed this Notice of Proposal to the Licence Appeal Tribunal.
The hearing commenced on June 12, 2012. No representative of the Applicant was in attendance. At the outset of the hearing, the Tribunal member noted that the Tribunal had received a letter dated May 11, 2012 from Counsel for the Respondent advising that liquor licence No. 809515 had been surrendered by the licensee of record, and that should the Applicant advise the Alcohol and Gaming Commission that it wished to pursue a new application, the Registrar would amend the Notice of Proposal to one to refuse to issue a licence. The Tribunal notes that there is no longer an existing liquor licence which can be the subject of a Notice of Proposal.
Mr. Morris advised the Tribunal that the Applicant had not submitted any further application and therefore withdrew the Notice of Proposal on behalf of the Registrar.
The Tribunal therefore orders:
- The Notice of Proposal to Refuse to Transfer a Licence dated March 9, 2012 having been withdrawn by the Registrar of Alcohol and Gaming, this matter before the Tribunal is concluded.
