DECISION AND ORDER
BACKGROUND
This is a hearing before the Licence Appeal Tribunal (the "Tribunal") arising out of two Orders of Monetary Penalty issued by the Registrar of Alcohol and Gaming, under the Alcohol and Gaming Regulation and Public Protection Act, 1996 (the "Registrar" and the "Act" respectively).
The Order dated January 18, 2012, imposed a monetary penalty on 7548419 Canada Ltd., operating as Eclipse Grill (the "Applicant"), with respect to contraventions of sections 43 and 45(1) of Ontario Regulation 719/90 under the Liquor Licence Act.
The Order dated February 13, 2012, imposed a monetary penalty on the Applicant with respect to a contravention of section 46 of Ontario Regulation 719/90 under the Liquor Licence Act.
Pursuant to a pre-hearing Order dated May 1, 2012, the Tribunal ordered that the two appeals be dealt with together at one hearing scheduled for May 2, 2012 in Barrie, Ontario.
The hearing proceeded as scheduled on May 2, 2012. Part way through the hearing, after evidence was heard from several witnesses, the Applicant's Agent advised the Tribunal that the Applicant was withdrawing its appeals in both matters.
Accordingly, the Tribunal orders and stipulates that, the appeals having been withdrawn, the matters are concluded and the Tribunal's files are hereby closed.
