AND IN THE MATTER OF A REQUEST FOR A STAY BY TESS WAXMAN OF STANDARDBRED RULING NUMBER 3720593

Decision:
The Panel grants the request for a stay, on consent.
WHEREAS Tess Waxman (“WAXMAN”) is licensed with the Alcohol and Gaming Commission of Ontario (“Commission”) as a Trainer, Licence Number W82245;
AND WHEREAS on May 25, 2026, Commission Racing Officials issued Standardbred Ruling Number 3720593 regarding the non-placing of the horse P H JIM on February 1st, 2026, at Flamboro Downs in the 4th race, after the three-quarter pole, around the last turn and into the head of the stretch;
AND WHEREAS the Judges determined that the race winner, 2 P H JIM, did not violate Standardbred Rule 18.08.02 and was the winner of the race as set out in the Standardbred Ruling 3720593 and it was determined that no placings were required;
AND WHEREAS on May 15, 2026, WAXMAN filed a Notice of Appeal and a Notice of Motion requesting a stay with the Panel to which the Registrar consented;
TAKE NOTICE that the Panel grants the request for a stay, on consent.
