Decision:
The Panel acknowledges the withdrawal of the appeal, on consent.
WHEREAS James Brian Bell (“BELL”) is licensed with the Alcohol and Gaming Commission of Ontario (“Commission”) as a Jockey, Licence Number JKY115594;
AND WHEREAS on September 24, 2025, BELL was the jockey of the horse, QUEEN CHARLOTTE;
AND WHEREAS on October 1, 2025, the Alcohol and Gaming Commission (AGCO) issued a monetary penalty in the amount of $500.00 and a three-day riding suspension in accordance with Thoroughbred Rules 9.27.07(d), 9.27.07(e), 9.27.08(a), 9.27.08(b), 16.13(d) and 24.04, for using his crop in the upright cocked position while urging his horse QUEEN CHARLOTTE during race five on September 24, 2025, at Ajax Downs, being that this is BELL’s third violation within a one-year period;
AND WHEREAS the riding suspension shall be served on May 13, 20 and 27, 2026 of 2026 and the monetary penalty to be paid on or before October 31, 2025;
AND WHEREAS on April 2, 2026, BELL filed a Notice of Appeal and a request for a stay;
AND WHEREAS on April 28, 2026, BELL made an oral request to withdraw his appeal, to which the Registrar consented;
TAKE NOTICE that the Panel acknowledges the withdrawal of the Appeal on consent.
