Decision:
The Panel acknowledges the withdrawal of the appeal, on consent.
WHEREAS Eswan Flores Hernandez (“FLORES HERNANDEZ”) is licensed with the Alcohol and Gaming Commission of Ontario (“Commission”) as a Jockey, Licence Number JKY1216388;
AND WHEREAS on November 15, 2025, FLORES HERNANDEZ was the jockey of the horse, “THE GREAT OZ”,
AND WHEREAS on November 19, 2025, Commission Racing Officials issued Thoroughbred Ruling Number 3458856 for coming in with his mount "THE GREAT OZ", interfering with WAR BOMBER during the stretch run of race eight on November 14, 2025 at Woodbine Racetrack and as a result, "THE GREAT OZ" finished first and was subsequently placed second in accordance with Rules 9.14.01, 9.14.02, 9.14.03, 11.07, 11.09.01, 11.09.03, 11.09.05, 11.12 and 11.14 of the Rules of Thoroughbred Racing;
AND WHEREAS on November 21, 2025, FLORES HERNANDEZ filed a Notice of Appeal and a Notice of Motion requesting a stay with the Panel to which the Registrar consented;
TAKE NOTICE that on December 29, 2025, the Panel granted the motion for a stay, on consent;
AND WHEREAS on January 8, 2026, the Appellant filed a written request to withdraw his appeal, to which the Registrar consented;
TAKE NOTICE that the Panel acknowledges the withdrawal of the appeal, on consent.
