Decision:
The Panel acknowledges the withdrawal of the appeal, on consent.
WHEREAS Jeffrey Gillis (“GILLIS”) is licensed with the Alcohol and Gaming Commission of Ontario (“Commission”) as An Owner/Trainer, Licence Number HPR9489;
AND WHEREAS on July 4, 2025, Commission Racing Officials issued Standardbred Ruling Number 3241406 to HENRY
AND WHEREAS on May 23, 2025, Standardbred Ruling 3158996 was issued to GILLIS for violating the Rules of Standardbred Racing (RULES) and engaged in conduct prejudicial to the best interests of racing;
AND WHEREAS on multiple occasions between October 14, 2018 and June 27, 2019, GILLIS purchased or attempted to purchase a substance that was or was held out to be erythropoietin or a synthetic derivative of erythropoietin, substances specifically prohibited by the Rules;
AND WHEREAS as part of an AGCO inspection regarding concerns about the purchase of prohibited substances, GILLIS was interviewed on December 13, 2023, by AGCO inspectors and withheld information and misled the inspectors;
AND WHEREAS GILLIS was found to have violated Rules 3.09.01, 6.05, 6.20, 6.27, 6.46.01(b)(c)(d)(e)(f), and 6.49(a) of the RULES;
AND WHEREAS in accordance with Rules 4.02(i), 6.04, and 6.49 of the Rules, and Policy Directive 1-2018, GILLIS was fully suspended for a period of 10 years and issued a monetary penalty of $40,000 with the suspension to be served from May 23, 2025, to May 23, 2035, inclusive;
AND WHEREAS on June 6, 2025, GILLIS filed a Notice of Appeal and a Notice of Motion requesting a stay with the Panel to which the Registrar did not consent;
AND WHEREAS on July 21, 2025, the Appellant requested an adjournment of the stay hearing date, to which the Registrar consented;
AND WHEREAS on July 29, 2025, the Panel granted the adjournment request of the stay hearing, on consent, with the stay hearing to be adjourned to September 12, 2025;
AND WHEREAS on September 8, 2025, the Panel received a written request to withdraw the request for a stay, to which the Registrar consented;
AND WHEREAS on September 22, 2025, the Panel granted the withdrawal of the motion for a stay, vacating the September 12, 2025 stay hearing date;
AND WHEREAS on January 7, 2026, the Appellant filed a written request for the withdrawal of the appeal, on consent;
TAKE NOTICE that the Panel acknowledges the withdrawal of the appeal, on consent.
