NOTICE OF DECISION

AND IN THE MATTER OF AN APPEAL BY TERRY GALLANT OF STANDARDBRED RULING NUMBER 3463104

Decision:
The Panel acknowledges the withdrawal of the appeal on consent.
WHEREAS Terry Gallant (“GALLANT”) is licensed with the Alcohol and Gaming Commission of Ontario (“Commission”) as a Horseperson/Driver/Owner/Trainer, Licence Number HP2154Z;
AND WHEREAS on November 7, 2025, GALLANT with respect to HRAP Appeal decision SB HRAP 05044 2025 was issued a $2000.00 monetary penalty and ordered to return purse monies earned by Rose Run Vortex (5R845) from August 13, 2023 to September 6, 2024 inclusive in the amount of eighteen-thousand one hundred and sixty-one dollars and seventy seven cents ($18161.77) and trainer fees of two thousand three hundred and thirteen dollars and seventy-seven cents ($2313.77)
AND WHEREAS pursuant to AGCO Rules 1.09, 5.11, 6.01(a)(c ), 6.15, 18.08.01 of the Rules, gallant will be full suspended on December 8 2025 for failing to pay the monetary penalty the purse money and trainers fees for redistribution. The suspension remains in effect until the monetary penalty is paid in full and all the purse money returned.
AND WHEREAS GALLANT will be prohibited from accessing Association grounds, including the “Winners Circle” with the exception of the grandstand while his license is suspended in accordance with Rule 6.01(a) of the Rules.
AND WHEREAS on November 21, 2025, GALLANT filed a Notice of Appeal and a Notice of Motion requesting a stay with the Panel;
AND WHEREAS the Registrar consented to the request for stay pending the release of the decision of the Appellant’s motion;
AND WHEREAS on December 11, 2025, the Panel granted the conditional stay on the aforementioned terms;
AND WHEREAS on December 5, 2025, GALLANT filed a Notice of Motion seeking clarification with respect to repayment;
AND WHEREAS on December 16, 2025, the Panel convened to hear the motion and dismissed the motion;
AND WHEREAS on January 5, 2026, the representative of the Appellant requested that the appeal be withdrawn, to which the Registrar consented,
TAKE NOTICE that the Panel acknowledges the withdrawal of the appeal, on consent.
