Decision

1The parties agreed to an expedited process under Article 22.16 of the collective agreement and the issuance of a brief, non-precedential award in relation to implementation issues which arose out of a memorandum of settlement dated February 22, 2012.

2The Employer issued a letter dated July 19, 2024, requesting repayment of amounts which it alleged the grievor owes the Employer as a result of issues which arose out of the implementation of the memorandum of settlement.

3Having heard these submissions of the parties it is my determination that the Employer cannot pursue the alleged overpayment set out in the letter of July 19, 2024.
