April 29, 2026

Decision

1The Board is seized with a grievance dated July 2, 2024, filed by Mr. Nathan Gomes (“Grievor”). The grievor applied for a job posting for a position of Level 6 Senior Economist but was not successful. The position was awarded to Mr. Cameron Kerr (Incumbent). The grievor and the Association have challenged the employer’s decision on a number of grounds.

2At the hearing on April 14 and 29, 2026, the incumbent, who had received notice as an interested party, was in attendance. The Association produced a book of documents which was provided to all attendees. The book included the Association’s particulars, and documents it intended to rely on. Counsel for the Association and the employer made opening statements on April 14, 2026.

3When the hearing resumed on April 29, 2026, the parties engaged in settlement discussions, but the grievance was not resolved. The next scheduled hearing date is in April of 2027. All of the parties had heard the opening statements and have copies of the Association’s book of documents.

4Following my discussions with counsel, I make the following order, which binds all of the parties, including the grievor and the incumbent:

The parties are hereby ordered that the information relating to this grievance, including the material in the Association’s book of documents, shall be kept strictly confidential, and used only with respect to the proceeding before the Board on the instant grievance. That information shall not be shared, disclosed or discussed otherwise, in the workplace or outside.
