Decision
1This grievance was allowed on May 20, 2025. I found that the Employer had breached Appendix 46 of the Collective Agreement when it awarded TEI benefits to a more junior employee. I further concluded that the Grievor was entitled to receive TEI benefits and the Employer was ordered to issue payment in accordance with Appendix 46.
2The parties have advised me that there is an ongoing dispute about the payment of benefits owed to the Grievor.
3A considerable period has passed since my award was issued. To address concerns arising from the delay, the Employer is directed to account for measures taken to date, including a complete breakdown of their calculation of the payment obligations owed to the Grievor and what it asserts has and has not been paid to him in fulfillment of their obligations. The Employer is to provide this information to the Union as soon as possible, but no later than March 31, 2026.
4I will continue to remain seized if a further issue arises regarding the interpretation or application of my decision.
