Decision
1The grievance alleges that the Employer breached the May 1, 2023 Extended Hours Memorandum of Agreement. The grievance alleges that the Employer failed to evenly distribute flex days, required employees to attend the workplace, suspended flex work arrangements during the summer of 2024, and failed to return employees to their original shift schedules following the suspension.
2The parties met on December 9, 2025 and January 29, 2026, and engaged in mediation and discussions respecting document production. Limited pre-hearing production has been exchanged. The parties agreed to the following case management schedule.
a) Prehearing Production
By March 16, 2026, the Employer shall provide, for each employee participating in the Extended Hours MOA Trial (Tab M of the Union’s Book of Documents),
the employee’s flex-day bidding preference,
the flex day and hours assigned,
the employee’s seniority, the employee’s pre-flex schedule,
the employee’s post-flex schedule,
the September 2023 notice to employees regarding the suspension of flex hours in summer of 2024.
3By June 1, 2026, the Union shall provide a draft Agreed Statement of Facts to the Employer. By July 3, 2026, the Employer shall provide its response. By September 6, 2026, the parties shall finalize an Agreed Statement of Facts.
4Any preliminary motions, outstanding pre-hearing production requests, or other procedural issues shall be addressed by conference call, if required.
5Continuation dates are scheduled for October 6, 2026 and November 23, 2026.
6All dates contained in this case management decision are subject to change on the agreement of the parties or by direction of the arbitrator.
