Decision
1On September 6, 2024, the Union filed a grievance on behalf of the Grievor alleging that the Employer is in breach of Articles 2, 3, 42, 46 of the Collective Agreement and also in breach of a negotiated settlement dated August 6, 2024 for GSB No 2023-02497.
2On July 7, 2025, the parties attended at the Grievance Settlement Board to arbitrate the September 6, 2024 grievance and allegations that the Employer has breached the August 6, 2024 settlement. This decision is issued in accordance with Article 22.16 of the collective agreement, and it is without prejudice or precedent.
3Having heard the submissions of the parties, and based on the unique circumstances of this case, I hereby order the following:
a) The Grievor’s current CTO bank for 2025 shall be reduced by 48 hours.
b) The Employer is not entitled to recover the over usage of 11.75 vacation credits in 2023.
c) I remain seized in the event of any dispute relating to the implementation of this order.
