Decision
1The Board is seized with a grievance dated 09/12/2024 filed by the grievor, Mr. Sean Insley, alleging that the employer violated article 6 with respect to a job competition he participated in.
2At the commencement of the hearing the parties raised a disagreement about the extent of disclosure they are entitled to from each other. The parties requested that the Board issue an Order having regard to their respective positions.
3Accordingly, the Board orders as follows:
(a) The Employer is directed to produce copies of the applications, interview records, and appraisals of the applicants who were interviewed in job competition ID 216909. The Employer may redact applicant names and personal identifying information from these materials, provided that it provides unique identifiers in place of such names to allow the Union to be able to cross reference individual applications and appraisals of those applications against other materials. The Employer is to provide such disclosure by August 8, 2025.
(b) The Parties and the Grievor agree that the information produced pursuant to this order is not to be used by either Party or the Grievor for any purpose other than for the present proceeding relating to the grievance regarding job competition ID 216909. At the conclusion of this proceeding, the Grievor is to delete or destroy any copies of the above-noted materials in his possession.
(c) The Parties may seek amendment of this Order, or seek additional orders with respect to production as may become necessary in the course of this proceeding.
4The Board remains seized.
