Decision
1This will confirm the parties’ discussions and the Board’s directions made on June 27, 2025.
2This confirms that the Employer intends to argue that the Board has no jurisdiction with respect to a competition for an excluded position. However, that argument will be made in the context of its submissions on the merits of the case. This further confirms that there are no preliminary objections being brought by the Employer.
3The Employer is hereby directed to produce to the Union any and all arguably relevant materials currently available by no later than Friday July 4, 2025.
4Any further materials are hereby directed to be produced by the Employer to the Union by no later than Friday, August 8, 2025.
5Should there be any outstanding production issues, those are to be addressed prior to October 8, 2025, the next scheduled hearing date. Should such production or other case management issues arise, counsel are to immediately inform the Board so that a case conference may be scheduled to deal with those issues.
6This hearing will continue on October 8, 2025 at which time it is expected that the Union will proceed with its case on the merits.
7In addition to dates already scheduled, this hearing will continue on September 1 and October 14, 2026. An amended notice of proceeding will issue in due course from the Board.
