CONFERENCE CALL

Decision
1Counsel for the Employer and Union attended a case conference call on May 23, 2025, to address outstanding procedural issues in relation to the above grievance.
2In the absence of a negotiated resolution to the grievance, and having regard to the submissions of the parties, I order as follows:
Further hearing dates will be scheduled for April 14, July 14 and 16, 2026, for the litigation of this matter.
On or before March 17, 2026, the Union will provide a statement of particulars to the Employer. The Union will also provide any arguably relevant documentation in its possession and respond to any production request from the Employer by this date.
With its statement of particulars, the Union may also make a production request of the Employer which is to be responded to in advance of the first hearing date on April 14, 2026.
The Union is directed to advise the Employer at the earliest opportunity of any issues it anticipates it may encounter in meeting these deadlines, including any non-availability or non-responsiveness on the part of the Grievor.
The Employer has specifically advised the Union and the Board that should the Union miss these deadlines, it reserves the right to argue that the grievance should be dismissed without a hearing. I remain seized to hear and determine any such motion from the Employer should it become necessary to do so.
Should there be any issues regarding the timelines set out above the Parties are to contact the Board for a further case conference call.
