Decision
1The Employer and the Union agreed to participate in the expedited Mediation-Arbitration process in accordance with the Memorandum of Agreement found in Appendix 2 to the collective agreement. Where a settlement cannot be reached the Memorandum of Agreement provides that the GSB shall issue a decision, without prejudice or precedent, and which not appealable.
2The Parties met on February 1, 2024 and April 4 2025. The Parties agreed to proceed pursuant to the Mediation-Arbitration process in accordance with the Memorandum of Agreement found in Appendix 2 to the collective agreement to ensure the grievance was addressed expeditiously. After I heard submissions from the Parties they asked that I issue a bottom line decision.
3The Grievor in this case claimed an unpaid ten (10) hours of work in or around October 2021. After considering the facts and submissions of the parties, I find the Grievor should be paid 10 hours, at the rate of pay at which they would have been earned, less applicable deductions and withholdings and less union dues.
4The LCBO shall issue the payment to the Grievor within thirty (30) days of the date of this decision.
